Terms of Sale
Last updated: [DATE]
1. About these Terms of Sale
These Terms of Sale govern anything you buy from LittleWorlds, however you buy it — on the website, in the game, on a computer or on a mobile device.
Every time you make a purchase, you accept these Terms of Sale. They apply alongside our Terms of Service and Privacy Policy; where a purchase is concerned and the two conflict, these Terms of Sale take priority.
When you place an order you are making an offer to buy. The contract between us is formed when we accept that offer, either by sending you a confirmation or by delivering what you ordered. Nothing on the website is an offer by us to sell — we can decline any order.
Seller: [LEGAL ENTITY OR OPERATOR NAME]. VAT number: [VAT NUMBER, IF REGISTERED].
2. What you are actually buying
We may sell:
- Gold — virtual currency, spendable inside LittleWorlds.
- [MEMBERSHIP NAME] — an optional paid membership with additional features.
- Individual virtual items — cosmetics and similar.
In every case, what you are buying is a limited, personal, non-transferable, revocable licence to use that content inside LittleWorlds. You are not buying property.
That means:
- Virtual currency, memberships, items and avatars have no real-world monetary value. They cannot be exchanged for cash, goods or services outside LittleWorlds.
- They remain ours. Your rights are limited to using them in the game, in line with our Terms of Service.
- They are consumed at the point of purchase — much like putting a coin into an arcade machine. What you're paying for is the play, not an asset.
- Where bought through a mobile carrier or app store, they are not redeemable for anything that carrier or store offers.
- Attempting to sell, transfer or trade them for real-world money or value outside the systems we provide will end the licence immediately.
- The licence ends if your account is closed, suspended or terminated, or if we discontinue the service.
We may add, remove, rebalance, reprice or devalue any virtual item, currency or feature at any time. This is normal in a live game, and you are not entitled to compensation for it.
3. Who can buy
You may only make a purchase if you are legally able to enter a contract and are authorised to use the payment method.
If you are under 18, you must have permission from a parent or guardian before buying anything, and permission from whoever owns the payment method. By placing an order you confirm you have both.
Parents and guardians: you are responsible for purchases made through your child's account and for setting up spending limits and controls on the payment method, the device and any app store or carrier account involved. If you find a purchase you didn't authorise, contact us at [SUPPORT EMAIL] — we'd rather sort it out with you than have it come back as a chargeback.
We may refuse, cancel or reverse any purchase we believe was made without proper authorisation.
4. Prices, currency and tax
- All prices are shown in [CURRENCY, e.g. GBP] and include VAT or other sales tax where it applies. The price you see at checkout is the price you pay.
- We may ask for your country of residence in order to apply the correct tax rate.
- Prices can change at any time. The price shown on the confirmation screen at the point you complete your order is the price that applies to that order.
- If a price is displayed incorrectly due to an obvious error, we may cancel the order and refund you in full rather than fulfil it. We'll tell you if that happens.
- We're not responsible for typographical errors, but we will honour anything you were reasonably led to believe you were buying.
5. Payment
Payments are handled by third-party payment providers. Your use of a provider is subject to that provider's own terms.
You confirm that you are authorised to use the payment method you provide, including any card or account associated with it.
We'll issue a receipt or confirmation for every purchase. Keep it — it's useful if anything goes wrong.
6. Subscriptions and automatic renewal
If [MEMBERSHIP NAME] is sold as a subscription:
- It renews automatically at the end of each billing period, at the then-current price, until you cancel.
- We'll tell you the price and the billing period clearly before you subscribe, and we'll remind you before any price increase takes effect.
- You can cancel at any time, through your account settings or by emailing [SUPPORT EMAIL]. Cancelling stops the next payment.
- When you cancel, your membership continues until the end of the period you've already paid for. We don't refund part-used periods unless the law requires it.
- If we increase the price, we'll give you at least [30] days' notice, and you can cancel before it applies.
- If a renewal payment fails, we may retry it, and may suspend membership benefits until it clears.
7. Your right to cancel, and refunds
Your statutory right to cancel. If you're a consumer in the UK or EU, you normally have 14 days to change your mind about digital content. However, that right is lost once delivery of the digital content has begun with your express consent.
Virtual currency, items and membership benefits are delivered immediately. By completing a purchase you:
- ask us to deliver it straight away, and
- acknowledge that you therefore lose your 14-day right to cancel.
If you'd rather keep that right, don't complete the purchase.
Outside that. Purchases are non-refundable, except at our discretion or where the law requires a refund — for example if what we supplied was faulty, not as described, or never delivered.
We will normally refund where a payment was taken in error, where a purchase was made without the account holder's authorisation, or where a technical fault meant you didn't receive what you paid for. Contact [SUPPORT EMAIL] within a reasonable time and we'll look into it.
We won't normally refund because you changed your mind, spent currency on something you regret, lost items in a trade, were banned for breaking the rules, or because a game update changed how something works.
Refunds go back to the original payment method. We may remove the corresponding currency, items or membership from your account when we issue one.
Nothing here affects your statutory rights as a consumer.
8. Chargebacks
If you believe a charge is wrong, please talk to us first — most problems are quicker to fix directly.
Raising a chargeback without contacting us may result in your account being suspended until it's resolved, and repeated or fraudulent chargebacks may result in a permanent ban. We may also recover reasonable costs charged to us by the payment provider.
9. If your account ends
If your account is closed, suspended or permanently banned — by you or by us — your licence to any currency, items or membership on it ends at the same time.
We won't refund or compensate you for anything unspent, unused or unexpired. This includes bans for breaching our Terms of Service or Community Guidelines.
10. If we stop running LittleWorlds
We may discontinue the service at any time. Where we can, we'll give advance notice and stop selling before we do.
If we discontinue the service, your licences end. Subject to your statutory rights, we're not obliged to refund unused currency or the remainder of a subscription period — though we'll try to be fair about it and will say clearly what we intend to do at the time.
11. Payment security
We take security seriously. Transactions are encrypted in transit using TLS, and we never store your full card details — those stay with our payment provider. See our Privacy Policy for how we handle your information.
If you spot an unauthorised charge, contact your bank or card issuer as well as us. Your bank has its own rules about liability for unauthorised transactions and can usually act faster than we can.
12. Things outside our control
We won't be in breach of these Terms if delivery is delayed or prevented by something beyond our reasonable control — including natural events, war, civil unrest, government action, terrorism, fire, flood, strikes, utility or network failures, server or hosting failures, cyber attacks, or serious technical faults.
If that happens, we'll deliver as soon as we reasonably can, or refund you if we can't.
13. Limitation of liability
We may revise or modify products, product descriptions or pricing without notice.
Our liability in connection with any purchase is limited as set out in our Terms of Service.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the statutory rights you have as a consumer, or for anything else that cannot lawfully be excluded.
14. Complaints
If something's gone wrong with a purchase, email [SUPPORT EMAIL] and tell us your username, what you bought, when, and what the problem is. We aim to respond within [5] working days.
If you're a consumer and we can't resolve it between us, you may be able to take the matter to an alternative dispute resolution scheme, or to the courts. You can also get free advice from Citizens Advice.
15. Governing law
These Terms of Sale are governed by the laws of [England and Wales / YOUR JURISDICTION], and its courts have jurisdiction over any dispute.
If you're a consumer resident elsewhere, this doesn't remove any protection given to you by the mandatory law of your country of residence, or your right to bring proceedings in your local courts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. General
- Severability. If any part of these Terms of Sale is unlawful or unenforceable, that part is severed and the rest still applies.
- Entire agreement. These Terms of Sale, with our Terms of Service and Privacy Policy, are the whole agreement about your purchases. If a purchase order, email or other message from anyone conflicts with them, these Terms of Sale apply — unless we've agreed otherwise in writing.
- No waiver. Not enforcing a term doesn't mean we've given it up.
- Assignment. You can't transfer your rights under these Terms. We may transfer ours if the project changes hands, without reducing your rights.
